Virtually all employers in Puerto Rico are required to provide workers’ compensation coverage through the Puerto Rico State Insurance Fund (CFSE).
Coverage is mandatory regardless of the number of employees.
No-Fault System
Puerto Rico workers’ compensation is a no-fault system administered exclusively through the State Insurance Fund (CFSE), meaning injured employees may receive benefits regardless of who caused the injury.
Reporting an Injury & Time Limits
A work-related injury must be reported to the employer immediately or as soon as possible.
The general statute of limitations to file a formal claim is one year from the date of injury.
Income & Medical Benefits
All medical treatment is provided exclusively through the State Insurance Fund (CFSE).
Disability benefits are provided based on the degree of disability and the employee’s wages.
Compensation for permanent disability or death benefits, if applicable.
Protection From Retaliation
An injured employee cannot be terminated or discriminated against for filing a workers’ compensation claim.
Choice of Treating Physician
All medical care is provided exclusively through the State Insurance Fund (CFSE) physicians and facilities.
Employees do not have the right to choose their own treating physician outside the CFSE network.
Independent Medical Examination (IME)
Medical evaluations are conducted within the CFSE system.
If there is a dispute, employees may seek a review within the CFSE administrative process.
