FEDERAL Workplace Injury?

 Accidents happen, and unfortunately, they can occur at work. If you've been injured on the job, it's crucial to know the right steps to take. 

When you are Injured on the Job, PLEASE notify your supervisor immediately. Not reporting  timely can possibly cause a denial of claim. Ask your supervisor for OWCP Form CA-1-Federal  Employee’s Notice of Traumatic Injury & Claim for Continuation of Pay/Compensation. In case  of an Occupational disease or illness, you should file OWCP Form CA-2-Notice of Occupational  Disease & Claim for Compensation. You should also ask for a signed OWCP Form  CA-16-Authorized for Examination and/or Treatment Form. Present this to the healthcare  provider for guarantee of payment by the agency. 

 Seek Immediate Medical Care. You should seek immediate care for your injury to prevent additional  injury or exacerbation of the original injury. This will also protect your right to pursue compensation  under FECA laws as this helps begin the medical documentation process for any future claims. 

You have the right to choose your treating physician. The agency might try to persuade you or  even force you to see an Agency Provider but remember, YOU do have the right to choose your own  medical provider as the physician of record. The physicians of Doctors’ Council can treat you for  an on the job injury. Call Sara Santiago for an appointment. 

 Submitting all forms and medical documentation. Please make sure to submit all relevant  information and all appropriate OWCP Forms and documentation in order to ensure a successful  outcome of your OWCP Claim. 

Please continue to see your treating during your OWCP claim. If you stop treatment with your doctor  without his/her release or authorization, you are at Risk of having this used as abandonment of  treatment and possible denial of your claim. 

Texas STATE Workplace Injury?

Accidents happen, and unfortunately, they can occur at work. If you've been injured on the job, it's crucial to know the right steps to take.

 You should report your injury to your supervisor or management as soon as you are aware  of the injury. Timely reporting is important. 

You have the right to choose your treating doctor. You do not have to be treated by the  company doctor. If your claim is a network claim, then the selection of doctor must be from  that WC Plan. Contact Ms. Santiago for assistance. The Emergency Room physician is not  considered your treating doctor. 

 Get the name/phone number of any person that witnessed the injury/accident 

 You must file a Notice of Injury/Claim (DWCC 41) with TDI within 1 year from your date of  Injury. 

 You are entitled to receive Temporary Income Benefits if you are unable to work 

 You must file a Notice of Injury/Claim (DWCC 41) with TDI within 1 year from your date of  Injury. 

You may receive Impairment Income Benefits if you are permanently injured. 

The Adjuster must request an order from TDI before you are required to see a doctor of their choice. 

Under Law, your employer cannot terminate you for filing a workers' compensation claim. 

LOUISIANA Work place Injury?

 You should report your injury to your supervisor or management as soon as you are aware of the injury.  Timely reporting is very important.  

 You have the right to choose your treating doctor.  You do not have to be treated by the company doctor; however, the law does allow your employer to have you see the company doctor for an initial visit.  

 The emergency room doctor is not considered to be your treating dr.  

 Workers’ Compensation Benefits are paid by the employer’s workers compensation insurance carrier or by the employer if they are self insured.  

 You may receive disability compensation for a portion of your wages if you are unable to work.  

 Any medical bills received should be forwarded to the workers’ compensation insurance carrier.    

 Under Louisiana Law, your employer can not terminate you for filing a workers’ compensation claim.
