Most employers in Louisiana with one or more employees are required to carry workers’ compensation insurance.
Certain agricultural and domestic employers may be exempt.
No-Fault System
Louisiana workers’ compensation is a no-fault system, meaning injured employees may receive benefits regardless of who caused the injury.
Reporting an Injury & Time Limits
A work-related injury must be reported to the employer within 30 days of the incident.
The general statute of limitations to file a formal claim is one year from the date of injury or from the last payment of medical benefits or indemnity.
Income & Medical Benefits
Payment for necessary medical treatment.
Temporary total disability (TTD) benefits at 66 2/3% of the average weekly wage.
Compensation for permanent partial or total disability, if applicable.
Supplemental earnings benefits may be available when the employee cannot earn pre-injury wages.
Protection From Retaliation
An injured employee cannot be terminated or discriminated against for filing a workers’ compensation claim.
Choice of Treating Physician
The employee is initially entitled to select their own treating physician.
A change of physician must be approved by the employer or insurance carrier, or by the Office of Workers’ Compensation.
Add language stating that while employees may choose their treating physician, they are required to see the Company doctor at least once.
Independent Medical Examination (IME)
Either party may request an IME if there is a dispute about the employee’s medical condition or treatment.
